"We want a legal test of the authority's decision to give the company a fine of NOK 20 million (USD 3 million) for allegedly illegal competitive practices," SAS Braathens CEO Petter Jansen told newspaper Stavanger Aftenblad.
According to the NCA, SAS Braathens practiced 'competition-damaging' underpricing on the route in order to muscle out competitor Coast Air. SAS Braathens has contested the fine several times, unsuccessfully.
Jansen said the the suit is also partly motivated out of a fear that the decision could force the company to drop less trafficked routes, or reduce capacity if confronted with a hard competitor on certain routes.
