What Waagaard meant as a harmless political protest turned into a nightmare as he faced a prison sentence after being prosecuted under a strict interpretation of a law prohibiting the hindrance of cabinet members.

Waagaard was convicted of violating Paragraph 99, hindering a cabinet member from carrying out their duty by the use of violence, threats or other illegal means.

Halvorsen was hit in the back of the head and neck with the cake as she tried to escape back into the Finance Ministry. She was forced to return home, change and shower, delaying her duties for about an hour.

The Supreme Court ruled that it was not clear that the necessary condition that causing this delay had been intentional on Waagaard's part - was present.

A majority found that the conviction should be repealed since it was not clear that the question of intent had been properly applied.
